Harmonizing to One AI Regulatory Standard Creates Gaps in Both Directions

Should you align your AI governance program to the most stringent regulatory standard?

If you chose the most restrictive AI governance framework to cover all of your jurisdictions, you didn't simplify compliance - you created a significant gap that runs in both directions simultaneously.

The Situation

The EU AI Act concentrates its heaviest obligations on providers and developers of AI systems, placing comparatively lighter requirements on deployers. However, the emerging U.S. state patchwork takes the opposite approach: Colorado's AI Act (SB 24-205, currently set for June 30, 2026, though a repeal-and-replace proposal is actively advancing) and California's CCPA/CPRA automated decision-making provisions impose direct accountability on deployers for consequential decisions, regardless of what the vendor disclosed or warranted. There is no single framework that simultaneously satisfies both regimes across all obligation types, and a company that calibrates its governance program to either standard alone is exposed in the other jurisdiction the moment a covered individual enters scope.

The Exposure

The board-level risk is that your governance program will be strong in one jurisdiction but incomplete in another, and you won't know which obligations you're missing until a regulator or plaintiff identifies them for you. A company harmonized to the EU AI Act won’t have any deployer-side impact assessment process, consumer notice mechanism, nor documented human oversight framework that meets the requirements emerging across U.S. state laws. On the other hand, a company harmonized to Colorado's deployer-centric standard won’t have addressed the EU's provider-facing obligations for AI systems developed or substantially modified in-house. In either direction, the gap is much more than a legal technicality, it's an unmanaged exposure within each jurisdiction that your governance program was never designed to handle.

The Judgment Call

The efficiency argument for harmonizing to a single standard is compelling, especially for mid-sized enterprises without large legal or compliance teams. But the efficiency gain isn’t justified. The right governance architecture will map obligations by jurisdiction and decision type, and then identify where deployer accountability sets the effective floor. For most companies with U.S. operations, that means the state-level deployer standards, not the EU AI Act, define the minimum governance requirements for any consequential AI decision. However, satisfying those deployer obligations doesn't satisfy the EU's provider-facing requirements, which is the point: a lowest common denominator doesn't exist, and treating either regime as sufficient to cover the other isn’t a strategy. A single adverse outcome in one incompletely-covered jurisdiction will cost more than the incremental investment in establishing a comprehensive approach.

  • Risk: Building jurisdiction-specific governance requirements adds real deployment friction, and internal stakeholders will push back on what looks like excessive risk management CYA.

  • Benefit: You eliminate the unmanaged gap in both directions, and the jurisdiction-specific documentation becomes your primary defense in both regulatory enforcement and consumer litigation.

  • What to do: Select your most consequential AI use case, and map each governance control in that process to the specific statutory obligation it satisfies in every jurisdiction where you operate.

  • Who to involve: General Counsel or outside regulatory counsel with cross-border AI experience, plus your Chief Compliance Officer or whoever owns the AI governance program.

  • What outcome to achieve: A controls-by-jurisdiction matrix for the AI use case, with specific state law statute references showing that your controls meet deployer requirements. Include a column for EU AI Act provider obligations if relevant for your business. Every empty cell is a gap that needs remediation.

  • Time required: 90 minutes to build the matrix and populate it with your current controls; one to two weeks for legal counsel to validate each jurisdiction's requirements; 30 minutes to review results.

Cross-Jurisdictional Legal Readiness Check

Before you build the matrix, confirm your legal team is equipped to validate it. If your counsel can't answer yes to all of these, the matrix will have unmanaged gaps.

  • Jurisdictional Scope Competency: Has your legal counsel reviewed the specific statutory definitions that trigger deployer accountability in each U.S. state where you have consumers or employees in scope?

  • Provider/Deployer Classification: Can your counsel confirm whether your organization qualifies as a provider, a deployer, or both under the EU AI Act, and whether that classification changes for any AI system developed or substantially modified in-house?

  • Cross-Framework Fluency: Has your counsel worked across both the EU AI Act and U.S. state AI statutes simultaneously? If not, are you relying on separate specialists who haven't reconciled the different obligations against each other?

  • Remediation Authority: Does your counsel have a direct line to the business owner of your most consequential AI use case, with the authority to flag a gap and pause deployment if a jurisdictional obligation is unmet?
